Pirate Marketing – Privacy Policy
Effective date: October 26, 2026
Last updated: October 26, 2026
1. Introduction and Scope
This Privacy Policy describes how Pirate Marketing LLC ("Pirate Marketing," "we," "us," or "our") collects, uses, shares, and protects personal information when you visit https://benperry.co (the "Site"), book a call with us, communicate with us, or buy or use our sales training, sales strategy, consulting, and coaching services (together, the "Services").
Pirate Marketing LLC is an online consulting business that serves online coaches, consultants, service businesses, and business owners. We deliver our Services online through video calls, email, and digital materials. For purposes of data protection laws that use these terms, Pirate Marketing LLC is the "controller" or "business" responsible for the personal information described here.
This policy covers information collected through the Site, our online forms and booking calendar, email, text messages, video calls, and our programs. It does not cover the practices of third-party websites or platforms we link to, which have their own privacy policies.
By using the Site or the Services, you acknowledge that you have read this Privacy Policy. If you do not agree with it, please do not use the Site or the Services.
2. How We Collect and Use Information
2.1 Information you give us
- Contact details: name, email address, phone number, and business name.
- Booking and screening information: answers you provide on our booking or application forms, such as details about your business, revenue range, goals, challenges, and how you heard about us.
- SMS consent choices: whether you opted in to non-marketing text messages, marketing text messages, both, or neither, along with the date, time, and method of your consent.
- Client information: information you share during calls, in emails or messages, or in worksheets and other program materials. This may include details about your business and sales process and, in coaching contexts, personal goals.
- Payment information: billing name, billing address, and payment details. Payments are handled by third-party payment processors such as Stripe. We do not store full card numbers on our own systems.
- Communications and posts: the content of emails, texts, and messages you send us, and anything you post in a program community, group chat, or other interactive feature.
2.2 Call recordings and notes
We may record calls, including strategy calls and coaching or consulting sessions, and we may use transcription and note-taking tools (such as Fathom or Zoom's built-in features) to create recordings, transcripts, and summaries. We record calls only after giving you notice and obtaining your consent, whether at the start of the call, during booking, or in your client agreement, as applicable law requires. If you do not want a call recorded, tell us before or at the start of the call. Where recording is optional, we will turn it off. Where recording is part of a program (for example, so participants can replay a training), we will tell you in advance.
2.3 Information collected automatically
When you visit the Site or open our emails, we and our service providers may automatically collect:
- device and browser details, such as browser type, operating system, and device type;
- IP address and the general location it indicates;
- pages viewed, links clicked, referring pages, and time on the Site;
- whether and when you opened an email or clicked a link in it; and
- information gathered through cookies, pixels, tags, and similar tools.
Cookies and similar technologies. Cookies are small data files stored by your browser. Pixels (also called web beacons) are tiny pieces of code in a web page or email that tell us when content has loaded. We use them to keep the Site, forms, and booking calendar working, remember your preferences, count visitors, understand how the Site is used, and measure our advertising. You can block or delete cookies in your browser settings, though some parts of the Site may not work properly as a result. The Site does not currently respond to "Do Not Track" browser signals. Where required by law, we will honor recognized opt-out preference signals such as Global Privacy Control, and we will ask for consent before setting non-essential cookies.
2.4 Information from other sources
We may receive information about you from our scheduling, CRM, payment, advertising, and video-conferencing providers in the normal course of running our business, and from public sources such as your business website or professional social media profiles.
2.5 How we use information
We use personal information to:
- schedule, confirm, remind you about, and conduct strategy calls and sessions;
- review screening answers to decide whether our Services are a good fit;
- provide, manage, and improve the Services, including program materials and client support;
- process payments, manage payment plans, and send receipts and billing notices;
- communicate with you by email, phone, and (with your consent) text message;
- send marketing communications where the law allows, and for text messages only with your separate consent;
- follow up if you start but do not finish a booking or checkout form;
- prepare call notes, summaries, and follow-up action items;
- show relevant ads to people who have visited the Site and measure how those ads perform (see Sections 3 and 4);
- maintain business records, prevent fraud, and protect our systems; and
- comply with legal obligations and enforce our Terms of Service (https://benperry.co/terms).
2.6 How we share information
We do not sell your personal information. We share it only as described below:
-
Service providers that process information for us to help run the business, including:
- GoHighLevel (CRM, scheduling, forms, email, and SMS);
- Zoom (video calls and, where applicable, recordings);
- Google Workspace (email, documents, and file storage);
- Fathom (call recording, transcription, and notes); and
- our payment processor (such as Stripe).
These providers may use your information only to provide services to us.
-
Advertising and analytics partners, such as Google and Meta, which receive device and browsing information through cookies and pixels as described in Sections 3 and 4. Their use of that information is also governed by their own privacy policies.
-
Professional advisers, such as attorneys, accountants, and insurers, who owe us duties of confidentiality.
-
Legal and safety reasons, when we believe disclosure is required by law, subpoena, or court order, or is needed to protect the rights, property, or safety of Pirate Marketing, our clients, or others.
-
Business transfers, if Pirate Marketing is involved in a merger, acquisition, sale of assets, or similar transaction, in which case personal information may be transferred as a business asset, subject to this Privacy Policy or a policy at least as protective.
-
With your direction or consent, for any other purpose you approve.
Text messaging information is subject to the additional limits in Section 5.
2.7 Information you make public
If you post information in a group call, community space, comment thread, or other shared area, other participants can see it and may use it. Please share only what you are comfortable sharing with the group. We are not responsible for how other participants or third parties use information you choose to make public.
2.8 Third-party sites and services
The Site may link to websites, booking pages, payment pages, or platforms that we do not control. When you use them, their own privacy policies apply, and we encourage you to read them.
3. Google Analytics and Google Advertising Features
We may use Google Analytics to understand how visitors find and use the Site. We may also enable certain Google Analytics advertising features, which may include:
- Remarketing, which lets us show ads on other websites to people who have previously visited the Site;
- Google Display Network Impression Reporting, which shows how ad impressions and interactions relate to visits to the Site;
- Integrations with Google's advertising platforms (such as Google Ads and Google Marketing Platform, formerly DoubleClick), which connect analytics data with ad delivery and measurement; and
- Demographics and Interests Reporting, which gives us aggregated, non-identifying insights about the age ranges, genders, and interests of our visitors.
When these features are turned on, we and Google may use first-party cookies (such as the Google Analytics cookie) together with third-party cookies (such as Google advertising cookies) or other identifiers to collect data about your activity on the Site, to decide which ads to show you, and to measure how well our ads work. We use this information only in aggregate or to deliver relevant advertising, not to identify you personally from analytics data alone.
Your choices. You can manage or turn off personalized Google ads at Google's Ad Settings page (adssettings.google.com), install the Google Analytics opt-out browser add-on (tools.google.com/dlpage/gaoptout), and opt out of interest-based ads from many participating companies through the Network Advertising Initiative (optout.networkadvertising.org) or the Digital Advertising Alliance (optout.aboutads.info).
The analytics tool we may use on the Site is Google Analytics. If we add other analytics tools, we will update this Privacy Policy.
4. Facebook and Instagram (Meta) Advertising
We may advertise on Facebook and Instagram, which are operated by Meta Platforms, Inc. ("Meta"), and we may use advertising pixels on the Site, such as the Meta Pixel and Google Ads tags.
- What we collect. If you interact with our ads, our Facebook or Instagram pages, or a Meta lead form, we may receive information you choose to provide (such as your name and email address) along with information about how you interacted with our ads. We handle that information as described in this Privacy Policy.
- Custom and lookalike audiences. We may use Meta's tools to show ads to people who visited the Site or are already on our contact list, or to reach people with similar characteristics. When we upload a contact list, Meta's tools convert the data into an encoded (hashed) format for matching, and Meta is not permitted to use it to build its own profiles.
- Limits on ad data. We follow Meta's advertising and data use policies. Specifically:
- We share ad data we receive from Meta only with service providers acting for us, and we require them to keep it confidential and secure.
- We use ad data from Meta only to understand and improve the performance of our own campaigns, and only in aggregated, non-identifying form unless Meta permits otherwise.
- We do not use Meta ad data, including the targeting settings of an ad, to create or add to profiles of individual people, browsers, or devices.
- We do not pass Meta ad data, in raw, aggregated, or derived form, to any ad network, ad exchange, data broker, or other advertising or data-monetization service.
- Your choices. You can control the ads you see on Meta's platforms through your Facebook or Instagram ad preferences.
5. SMS / Text Messaging
This section applies if you give us your mobile number and opt in to receive text messages from Pirate Marketing.
Consent. We send text messages only to people who have opted in, for example by checking an SMS consent box on our booking form. Our form offers two separate, optional choices: (1) non-marketing messages and (2) marketing messages. You may choose either, both, or neither. Consent to receive text messages is not a condition of purchase or of booking a call.
Message types.
- Non-marketing (transactional/informational) messages: confirmations, reminders, and updates about scheduled strategy calls and sessions, rescheduling notices, and replies to your questions.
- Marketing messages (only if you separately opt in): information about our programs, offers, events, and promotions.
Message frequency. Message frequency varies. For non-marketing messages, you can expect up to 5 messages per scheduled call. For marketing messages (if you opt in), you can expect up to 4 messages per month.
Message and data rates may apply. Check with your mobile carrier for details about your plan.
Opting out and help. You can reply STOP to any message to opt out at any time. After you reply STOP, we will send one final message confirming that you have been unsubscribed, and you will receive no further texts unless you opt in again. Reply HELP for help, or contact us at ben@benperry.co. Carriers are not liable for delayed or undelivered messages.
Privacy of mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We may share mobile information only with the service providers that help us deliver text messages (such as our SMS platform and its carrier partners), and only to provide that service.
6. Your Privacy Rights and Choices
Depending on where you live, you may have the right to:
- access the personal information we hold about you and get a copy;
- correct inaccurate information;
- delete your information, subject to legal exceptions;
- object to or restrict certain processing;
- data portability, meaning a copy in a commonly used format;
- withdraw consent where we rely on consent; and
- opt out of marketing communications at any time.
How to exercise your rights. Email ben@benperry.co with the subject line "Privacy Request" and describe what you are asking for. We may need to verify your identity before responding, and we will respond within the time required by applicable law. You may use an authorized agent where the law allows, and we may ask for proof of the agent's authority. We will not treat you differently for exercising your rights.
Marketing opt-outs. You can unsubscribe from marketing emails at any time using the link included in every marketing email, and you can opt out of text messages by replying STOP.
6.1 California residents
If the California Consumer Privacy Act, as amended (CCPA), applies to us, California residents have the rights to know, access, correct, and delete their personal information, and to opt out of the "sale" or "sharing" of personal information. We do not sell personal information. Our use of advertising cookies and pixels described in Sections 3 and 4 may be considered "sharing" for cross-context behavioral advertising under California law. You can opt out by emailing ben@benperry.co with the subject line "Privacy Request." We also honor Global Privacy Control signals where required by law. We do not knowingly sell or share the personal information of anyone under 16. The categories of information we collect, their sources, purposes, and recipients are described in Section 2.
6.2 Other U.S. states
Residents of other states with consumer privacy laws (for example, Tennessee, Virginia, Colorado, Connecticut, and Texas) may have similar rights where those laws apply, including the right to opt out of targeted advertising. If we deny your request, you may appeal by replying to our decision with the subject line "Privacy Appeal."
7. GDPR: Visitors from the EU, UK, and Switzerland
Our business is based in the United States and is aimed mainly at U.S. clients. If the EU or UK General Data Protection Regulation (GDPR) applies to our processing of your personal information, we will comply with its applicable requirements.
Legal bases. We process personal information on these legal bases:
- Contract: to take steps you request before entering into a contract (such as booking a call) and to perform our contract with you (such as delivering a program).
- Consent: for marketing text messages, non-essential cookies and advertising pixels, and call recordings where consent is the applicable basis. You may withdraw consent at any time; this does not affect processing that happened before you withdrew.
- Legitimate interests: to run and improve our business, respond to inquiries, send relevant business communications where permitted, keep records, and protect our systems, as long as those interests are not outweighed by your rights.
- Legal obligation: to comply with tax, accounting, and other legal requirements.
Your GDPR rights. You may request access to, correction of, deletion of (sometimes called the "right to be forgotten"), restriction of, or a portable copy of your personal data, and you may object to processing, including for direct marketing. To make a request, email ben@benperry.co. You also have the right to complain to your local data protection authority, though we would appreciate the chance to address your concern first.
International transfers. Our service providers may store and process information in the United States and other countries whose data protection laws may differ from those where you live. When we transfer personal data from the EEA, UK, or Switzerland, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses or the EU-U.S. Data Privacy Framework (and its UK and Swiss extensions) where our providers participate.
8. Children's Privacy Statement
The Site and Services are intended for business owners and professionals and are not directed to anyone under 18. We do not knowingly collect personal information from anyone under 18, and we do not knowingly allow anyone under 18 to post or share personal information through the Site or our programs. Because we do not knowingly collect information from minors, we do not knowingly disclose it to anyone. If we learn that we have received personal information from someone under 18, we will delete it. If you believe a minor has given us personal information, contact us at ben@benperry.co. This also satisfies our obligations under the U.S. Children's Online Privacy Protection Act (COPPA), which protects children under 13.
9. How Do We Store and Protect Your Information?
Where it is stored. Your information is stored with our service providers, mainly in our CRM, email, scheduling, payment, video, and file-storage systems described in Section 2.6. Access is limited to Pirate Marketing and the people and providers who need it to run the business and deliver the Services.
Security. We use reasonable administrative, technical, and physical safeguards, such as access controls, multi-factor authentication on key accounts, and reputable providers that use encryption. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send sensitive information (such as full card numbers or government ID numbers) by email or text.
Retention. We keep personal information only as long as reasonably needed for the purposes in this policy, including to provide the Services, keep business and financial records, resolve disputes, and enforce our agreements. As a general guide:
- Prospect and booking information: up to 3 years after our last interaction with you, unless you become a client.
- Client records and payment records: for the length of the relationship and up to 7 years afterward for tax, accounting, and legal purposes.
- Call recordings and transcripts: up to 2 years after the call, unless needed longer for program delivery or legal reasons.
- SMS consent records: as long as required to show consent under applicable law.
When information is no longer needed, we delete it or de-identify it.
Unsubscribing. Every marketing email we send includes an unsubscribe link, and you can opt out of texts at any time by replying STOP.
10. Changes to This Policy (Disclaimer)
We may update this Privacy Policy from time to time to reflect changes in our practices, tools, or the law. When we do, we will post the updated version on this page and change the "Last updated" date above. If the changes are material, we will also give additional notice, such as a notice on the Site or by email. Your continued use of the Site or Services after an update means you accept the revised policy.
